1. About Wild Open Water
Wild Open Water ("Wild", "we", "us", "our") is a web-based platform that provides information about open water swimming locations across the United Kingdom, including live environmental data, community reports, and swim spot discovery tools. The platform is operated from the United Kingdom.
2. Acceptance of Terms
By accessing or using Wild Open Water, you agree to be bound by these Terms of Use. If you do not agree, you must not use the platform. We may update these terms from time to time. Continued use constitutes acceptance of any changes.
3. The Service
Wild Open Water provides environmental and community-sourced information about open water swimming locations. This includes tide predictions, water temperature estimates, water quality data, weather conditions, and user-submitted reports. The service is provided free of charge.
4. Important Safety Disclaimer
Open water swimming carries inherent risks including drowning, hypothermia, water quality hazards, and changing conditions. Information provided on Wild Open Water is for general guidance only and must not be relied upon as a substitute for your own judgement, local knowledge, or professional safety advice.
Water temperature estimates for lakes and rivers are derived from published scientific models and may differ from actual conditions. Tide predictions are forecasts, not guarantees. Water quality data reflects periodic testing and may not reflect current conditions. Always check local signage, consult with lifeguards where available, and swim within your ability.
5. Data Sources and Accuracy
We aggregate data from authoritative sources including NOAA, ECMWF, the Copernicus Marine Service, WorldTides, and the Environment Agency. While we make reasonable efforts to present accurate information, we do not guarantee the accuracy, completeness, or timeliness of any data. Third-party data is subject to the terms and limitations of the original providers.
Community-submitted content reflects individual opinions and experiences. We do not verify the accuracy of community posts and accept no liability for decisions made based on community content.
6. User Accounts
You may create an account to access additional features such as saving favourites and submitting community posts. You are responsible for maintaining the security of your account credentials. You must not create accounts for automated or bulk access to the service.
7. Community Content
By submitting content (posts, reports, comments) to Wild Open Water, you grant us a non-exclusive, royalty-free licence to use, display, and distribute that content on the platform. You retain ownership of your content. You must not submit content that is false, misleading, abusive, or illegal. We reserve the right to remove any content at our discretion.
8. Intellectual Property
The Wild Open Water platform, including its design, code, branding, and original content, is owned by us and protected by copyright and other intellectual property laws. You may not reproduce, modify, or distribute any part of the platform without our written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Wild Open Water and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform or reliance on information provided. This includes, without limitation, any injury, loss, or damage arising from swimming or other activities undertaken based on information from the platform.
10. Availability
We aim to keep Wild Open Water available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time without notice.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
